1. INTRODUCTION

This privacy policy explains how attorney Tomislav Maros, or the law firm Maros Legal (hereinafter referred to as ‘Maros Legal’), collects and processes personal data about you for the purpose of fulfilling the mandate agreement concluded with you and in connection with your use of the website www.maros.legal (hereinafter referred to as the ‘website’).

2. PERSONAL DATA

The protection of your personal data and privacy is of particular concern to Maros Legal. Maros Legal collects, processes and uses your personal data only with your consent or mandate or appointment for the purposes agreed with you or if there is another legal basis in accordance with the General Data Protection Regulation (hereinafter ‘GDPR’); this is done in compliance with data protection and civil law provisions.

Only personal data that is necessary for the performance and processing of Maros Legal’s legal services or that you have voluntarily provided to Maros Legal will be collected. For visitors to the website, further information can be found under points 9 and 10.

Personal data is any data that contains individual details about personal or factual circumstances, such as name, address, email address, telephone number, date of birth, age, gender, social security number, video recordings, photos, voice recordings of persons, and biometric data such as fingerprints. Sensitive data, such as health data or data related to criminal proceedings, may also be included.

3. YOUR RIGHTS

As a client or generally as a data subject, you have the right at any time – subject to the lawyer’s duty of confidentiality – to obtain information about your stored personal data, its origin and recipients, and the purpose of data processing, as well as the right to correction, data transfer, objection, restriction of processing, and blocking or deletion of incorrect or inadmissibly processed data.

You have the right to revoke your consent to the use of your personal data at any time. Your request for information, deletion, correction, objection and/or data transfer, in the latter case provided that this does not involve disproportionate effort, can be sent to the address of Maros Legal listed in point 11 of this statement.

If you believe that the processing of your personal data by Maros Legal violates applicable data protection law or that your data protection rights have been violated in any other way, you have the option of lodging a complaint with the competent supervisory authority. In Austria, the Data Protection Authority (Datenschutzbehörde) is responsible for this.

4. DATA SECURITY

Your personal data is protected by appropriate organisational and technical measures. These measures relate in particular to protection against unauthorised, unlawful or accidental access, processing, loss, use and manipulation.

Despite our efforts to maintain a consistently high standard of due diligence, we cannot rule out the possibility that information you disclose to Maros Legal via the internet may be viewed and used by other persons.

Please note that Maros Legal therefore accepts no liability whatsoever for the disclosure of information due to errors in data transmission not caused by Maros Legal and/or unauthorised access by third parties (e.g. hacking of email accounts or telephones, interception of faxes).

5. USE OF DATA

Maros Legal will not process the data provided for purposes other than those covered by the client agreement or by your consent or otherwise by a provision in accordance with the GDPR. This does not apply to use for statistical purposes, provided that the data provided has been anonymised.

Maros Legal processes personal data for the purpose of fulfilling the services owed to the client under the client relationship, fulfilling other contractual obligations, fulfilling relevant legal obligations to which Maros Legal is subject (in particular professional regulations) and safeguarding the legitimate interests of Maros Legal (e.g. direct marketing).

The legal basis for this is provided by the relevant data protection regulations, in particular Art. 6(1) (and in some cases also Art. 9(2) and Art. 10) of the GDPR.

6. TRANSFER OF DATA TO THIRD PARTIES

In order to fulfil your order, it may also be necessary to transfer your data to third parties (e.g. opposing parties, substitutes, insurance companies, service providers used by Maros Legal and to whom Maros Legal provides data, such as translators, etc.), courts or authorities. Your data will only be forwarded on the basis of the GDPR, in particular to fulfil your order or on the basis of your prior consent.

Furthermore, Maros Legal informs you that, within the scope of legal representation and support by Maros Legal, factual and case-related information about you is regularly obtained from third parties.

Some of the above-mentioned recipients of your personal data are located outside your country or process your personal data there. The level of data protection in other countries may not be the same as in Austria. However, Maros Legal only transfers your personal data to countries for which the EU Commission has decided that they have an adequate level of data protection, or Maros Legal takes measures to ensure that all recipients have an adequate level of data protection, for which Maros Legal concludes standard contractual clauses (2010/87/EC and/or 2004/915/EC).

7. NOTIFICATION OF DATA BREACHES

Maros Legal endeavours to ensure that data breaches are detected at an early stage and, if necessary, reported to you or the competent supervisory authority without delay, including the respective categories of data affected.

8. DATA RETENTION

Maros Legal will not retain data for longer than is necessary to fulfil our contractual or legal obligations and to defend against any liability claims.

9. COOKIES

This website uses cookies to make it more user-friendly, effective and secure.

A ‘cookie’ is a small text file that we transfer via our web server to the cookie file of your browser on your computer’s hard drive. This enables the website to recognise you as a user when a connection is established between the Maros Legal web server and your browser. Cookies help us to determine the frequency of use and the number of users of our website. The content of the cookies used by Maros Legal is limited to an identification number that no longer allows any personal reference to the user. The main purpose of a cookie is to recognise visitors to the website.

Three types of cookies are used on this website:

  • Session cookies: These are temporary cookies that remain in your browser’s cookie file until you leave the website and are automatically deleted at the end of your visit.
  • Persistent cookies: For better user-friendliness, cookies remain stored on your device and allow Maros Legal to recognise your browser the next time you visit.
  • Functional Cookie: This website uses a technically necessary cookie to store the visitors selected language. This cookie (pll_language”) is used solely to ensure that the content is displayed in the correct language. It does not store any personal data and is not used for analytics or marketing purposes. The cookie is automatically deleted when the browser is closed.

 

You can set your browser so that you are informed about the setting of cookies and only allow cookies in individual cases, exclude the acceptance of cookies for certain cases or in general, and activate the automatic deletion of cookies when you close your browser. If you deactivate cookies, the functionality of this website may be restricted.

If cookies are used for purposes other than these two (e.g. cookies to analyse the surfing behaviour of website visitors), Maros Legal will obtain the consent of the website visitor. The website visitor may, but is not required to, give their consent to the use of such cookies; this is done on a voluntary basis. The website visitor can also revoke their consent at any time by changing their browser settings (to disallow cookies). If cookies are not allowed, the functionality of this website may be limited.

10. SERVER-LOG-FILES

In order to optimise this website in terms of system performance, user-friendliness and the provision of useful information about Maros Legal’s services, the website provider automatically collects and stores information in so-called server log files, which your browser automatically transmits to Maros Legal. This includes your Internet Protocol address (IP address), browser and language settings, operating system, referrer URL, your Internet service provider and date/time.

This data is not merged with personal data sources. Maros Legal reserves the right to check this data retrospectively if there are concrete indications of illegal use.

Maros Legal uses Google Analytics, a web analytics service provided by Google, on its website. Google is certified under the EU-U.S. Privacy Shield.

Google Analytics is used to analyse how visitors use our website. For this purpose, Google collects customer data based on page views, which relate to the technical characteristics and activities of website visitors. This customer data is evaluated by the processing software to create reports that may include information on dwell time, approximate geographical origin, origin of visitor traffic, exit pages and usage patterns.
